By purchasing and using EPUB to XTC Converter, you agree to these terms. Please read them carefully.

1. License Grant

Upon purchase, you receive a non-exclusive, non-transferable license to use EPUB to XTC Converter on devices you own or control. This is a single-user license.

You may:

• Install and use the software on multiple devices you personally own
• Convert unlimited EPUB files to XTC format
• Use the software for personal, non-commercial purposes
• Use the software for commercial purposes to convert books you own or have rights to

You may not:

• Share your license key with others
• Redistribute, resell, or sublicense the software
• Reverse engineer, decompile, or disassemble the software
• Remove or modify any copyright notices or licensing information
• Use the software to convert copyrighted material you don't have rights to

2. Ownership and Copyright

You own the XTC files you create using this software. The software itself remains the property of its creator and is protected by copyright law.

You are solely responsible for ensuring you have the legal right to convert any EPUB files you use with this software.

3. Payment and Refunds

EPUB to XTC Converter is sold as a one-time purchase for $9.99 USD.

Refund Policy:

• We offer a 14-day money-back guarantee
• To request a refund, contact support@smoltools.com within 14 days of purchase
• Refunds are processed within 5-7 business days
• Your license will be revoked upon issuing a refund

No refunds will be provided after 14 days except where required by law.

4. Activation and Internet Connection

The software requires a one-time internet connection for license activation. After activation, the software works completely offline.

You may deactivate your license on one device to activate it on another by contacting support.

5. Updates and Support

Lifetime Updates:

• You receive all updates and bug fixes for this major version at no additional cost
• Future major versions (e.g., 2.0) may require a separate purchase
• We determine what constitutes a major vs. minor version

Support:

• Email support is provided on a best-effort basis
• We aim to respond within 48 hours during business days
• Support does not include custom development or feature requests

6. Acceptable Use

You agree to use the software in compliance with all applicable laws. You will not:

• Use the software to infringe on others' intellectual property rights
• Convert EPUB files you don't own or have permission to convert
• Use the software for any illegal purpose
• Attempt to circumvent licensing or activation mechanisms

7. Device Compatibility

This software is designed specifically for XTeink X3 and X4 e-readers. While we strive for full compatibility, we cannot guarantee the software will work with all device configurations or future firmware updates.

Check the minimum system requirements before purchasing:

• macOS 10.15 or later
• Windows 10 or later
• Linux (recent distributions with standard libraries)

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. We do not warrant that XTC files will display identically to EPUB files or work perfectly on all devices.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE ($9.99 USD).

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Copyright Responsibility

You acknowledge that EPUB files may be protected by copyright. You are solely responsible for ensuring you have the legal right to convert any EPUB file.

This software is a tool for format conversion. We do not encourage, support, or condone copyright infringement. Converting copyrighted material without permission is illegal and violates these terms.

11. Privacy

Your use of the software is also governed by our Privacy Policy. We do not access, upload, or scan your EPUB files. All conversions happen locally on your device.

12. Termination

We may terminate your license if you violate these terms. Upon termination:

• Your right to use the software ends immediately
• You must delete all copies of the software
• No refund will be provided for violations of terms

Sections that by their nature should survive termination will survive (including ownership, disclaimers, and limitations of liability).

13. Changes to Terms

We may update these terms from time to time. We'll notify you of material changes via email. Continued use of the software after changes constitutes acceptance.

If you don't agree to updated terms, you may request a pro-rated refund within 30 days of notification.

14. Governing Law

These terms are governed by the laws of the jurisdiction in which the software creator is based, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of that jurisdiction, except where mandatory consumer protection laws require otherwise.

15. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the software. They supersede any prior agreements or understandings.
